第58回 STIG PoPセミナー「The role of the IAEA in the development of nuclear law」を7月20日（木） に開催しました。講師に、国際原子力機関 のWolfram Tonhauser 氏（Section Head for Nuclear and Treaty Law, Office of Legal Affairs） を招き、原子力安全と核セキュリティの問題に対する国際的な法的責任の在り方や、国際的合意やIAEAの安全基準をどのように各国の法制度の中で実行していくか、といった話題を議論しました。 セミナーには、東京大学の学生に加えて、複数の大学教員や官庁の法務部門等で働く実務家など、23名が参加しました。
はじめにTonhauser氏は、IAEAの三つの重要な役割として、１）国際協定の締結、２）基準や勧告の発行、３）条約や行動規範の締結に関する加盟国の支援、を挙げ、具体例を説明しました。この中で、法的拘束力のない基準や勧告をピアレビュー等のメカニズムを通じて国内法へと取り込むよう支援することの重要性が強調されました。
参加者からは、原子力賠償において国際標準（原子力事業者に一義的な賠償責任を負わせること）とは異なる法制度をとる原子力新規導入検討国があるのはなぜか、より強い法的拘束力を持ったピアプレッシャーの枠組みを構築することはできないか、といった具体的な質問が提起され、活発な議論が行われました。（長岡技術科学大学 村上健太准教授）
【セミナー概要】
The presentation will describe the normative role of the IAEA in nuclear law with an emphasis on nuclear safety and security. It will outline the relevant international legal framework, the Agency’s law making authority and how IAEA safety standards and security guidance documents are developed and implemented. The presentation will also describe and touch upon current issues and trends in international nuclear law.

Wolfram Tonhauser joined the Office of Legal Affairs of the IAEA in 1993 and is currently the Section Head for Nuclear and Treaty Law in that office. In this capacity, he advises on all legal aspects related to nuclear safety and security, nuclear energy, nuclear applications, technical cooperation and civil liability for nuclear damage.
He has served as scientific secretary to many international meetings and conferences in these fields. He has also been the IAEA officer responsible for the negotiation of the Convention on Nuclear Safety, the Joint Convention on the Safety of Spent Fuel Management and the Safety of Radioactive Waste Management, the Amendment to the Convention on the Physical Protection of Nuclear Material, the Code of Conduct on the Safety and Security of Radioactive Sources and the Code of Conduct on the Safety of Research Reactors.
Wolfram Tonhauser has published numerous articles in different areas of nuclear law, including nuclear safety, security and civil liability for nuclear damage. He is a co-author of the IAEA’s Handbook on Nuclear Law, Volumes I and II, and manages the IAEA’s Legislative Assistance Programme, which provides education and training to IAEA Member States in all areas of nuclear law and assists them in drafting corresponding national legislation.
He is a regularly invited speaker at various academic institutions, including the International School of Nuclear Law at the University of Montpellier and the Summer Institute of the World Nuclear University.
